1. Acceptance of These Terms

These Terms and Conditions ("Terms") form a legal agreement between you and Growth Estate Inc. ("Growth Estate", "we", "us", or "our"). By accessing or using growthestate.ca and related web Services, you agree to these Terms. If you do not agree, do not use the Services.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility and Lawful Use

You must be legally capable of entering into a binding agreement to use the Services. You may use the Services only in compliance with applicable laws and only for lawful purposes.

3. The Services

Growth Estate provides informational content, waitlist and contact forms, and related website features about its software. The Ontario Landlord mobile application is governed by the separate App Terms.

The Services are designed to assist with landlord education and product interest. They do not replace independent legal judgment.

4. No Legal Advice

Content on this website, including blog posts and product descriptions, is for general informational purposes only. It is not legal advice and does not create a solicitor-client or paralegal-client relationship. For complex litigation or high-risk scenarios, consult a qualified lawyer or licensed paralegal.

5. User Responsibilities and Prohibited Uses

You agree to provide accurate information, use the Services only for lawful purposes, and not interfere with or disrupt the website. You must not use the Services for unlawful, misleading, fraudulent, harassing, or abusive activity; upload malware; scrape or reverse engineer the Services except as permitted by law; or send unauthorized marketing in violation of CASL.

6. Privacy

Our collection, use, disclosure, and handling of personal information is described in our Privacy Policy, which forms part of these Terms. App-specific practices for Ontario Landlord are described in the App Privacy Policy.

7. Intellectual Property

The website, including branding, design, text, graphics, and content created by Growth Estate, is owned by or licensed to Growth Estate Inc. and protected by intellectual property laws. You may not reproduce, distribute, modify, sell, or create derivative works from the Services except as expressly permitted.

8. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." GROWTH ESTATE DISCLAIMS ALL REPRESENTATIONS, WARRANTIES, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF GROWTH ESTATE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO GROWTH ESTATE FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; AND (B) CAD $100.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Subject to applicable law, the courts located in Ontario will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the website Services.
